'Obligations and Liability of (Outside) Counsel in Mediation Proceedings' Outside counsel in mediation proceedings typically faces the situation of being instructed to advise on aspects of law whereas the proceeding itself is not aimed at evaluating the legal positions. The author discusses if and to which extent counsel is under an obligation to actively engage in mediation proceedings with express legal input. The analysis broadly discusses all relevant precedents and sets out criteria for a possible liability of counsel.
