Beschreibung
The Maritime Lien is one of the most crucial and widely-used remedies within the Law of Admiralty. It allows a claimant to, amongst other things, attach his or her claim to the vessel making the claim one that is against the vessel without the need to commence legal proceedings against the owner of the vessel. As such, the Maritime Lien has been designed through well settled principles of Law to support a proprietary claim. This book evaluates the state of the Maritime Lien in the light of the decision in the Indian Grace No.2 which raises legal issues regarding the nature of the Maritime Lien and its distinct uniqueness as a claim in rem.
