'Binding Effect Created through Promise or Contract' What insights can be gained from an interdisciplinary approach in modern legal scholarship? The thesis contrasts a traditional dogmatic perspective enriched by historical and philosophical influences with an efficiency-centered economic analysis with regard to the legal construction and evolving problems of rewards under German and English law. As to this legal question, which mirrors the fundamental problem of justifying a one-sidedly created obligation against the concept of contract, the analysis illustrates the paradigm importance of the perspective taken for the results achieved. Hereby, it seeks to highlight the viable joint potential of combining different national as well as methodological approaches to reach a more differentiated and profound understanding of legal problems.
Autorenporträt
Henriette Karoline Sigmund nahm ihr Studium der Rechtswissenschaft an der Universität Heidelberg auf. Nach einem Auslandsstudium in Genf mit Teilnahme am Willem C. Vis Arbitration Moot Court setzte sie ihr Studium in Frankfurt a.M. fort und legte die Erste Juristische Prüfung ab. Begleitend zu ihrer Tätigkeit als wissenschaftliche Mitarbeiterin am Lehrstuhl von Prof. Dr. Tobias Tröger, LL.M. (Harvard), für Bürgerliches Recht, Handels- und Wirtschaftsrecht und Rechtstheorie fertigte sie ihre Dissertationsschrift unter Förderung durch ein Promotionsstipendium der Studienstiftung des deutschen Volkes an. Seit 2017 befindet sie sich im juristischen Vorbereitungsdienst.
