'Bodily Harm in Light of the COVID-19 Pandemic. The Criminal Liability Due to the Infection with SARS-CoV-2 of another Person According to the §§ 223 ff. of the German Criminal Code': The thesis examines the criminal liability for the infection with SARS-CoV-2 of another person according to the §§ 223 ff. of the German Criminal Code. Especially the possibility of an asymptomatic course and the burden of proving causality, only make attempted simple bodily harm a conceivable scenario. This 'gap' in German criminal law can nevertheless not be filled by creating a new abstract endangerment offense due to the principle of last resort.
Autorenporträt
Alessandra Maria Helena Simmer studied law at the LMU Munich and passed her first state examination in 2017. After her legal clerkship at the Higher Regional Court of Munich, she passed the second state examination in 2019. In 2021, she obtained an LL.M. in Forensics, Criminology and Law at Maastricht University. From 2021 to 2023, she was a research assistant at the University of Augsburg, where she received her doctorate in 2024. Since 2023 she has been working as a lawyer at Knauer Partnerschaft von Rechtsanwälten mbB in Munich.
