Beschreibung

One of the central aims of law is to achieve justice in its application. Justice must prevail no matter whose ox is gored and justice is a respecter of no person as displayed in the Latin Maxim: fiat justitia ruat coelum which means let justice be done even though the heavens fall. Plea bargaining is one of the major stride at finding a solution to every legal system yearning for justice. The writer in chapter two examined the concept of plea bargaining from different sources, that is, a conceptual clarification. In chapter three the researcher examined the legal framework for plea bargaining in Nigeria. The researcher went ahead to consider in chapter four whether plea bargain is relevant and applicable in capital offences related crimes and came to the conclusion ably backed by the opinions of learned authors that plea bargain cannot be relevant in cases carrying the maximum penalty such as murder.Chapter five provided some forms of observations, recommendations and also suggested other areas for further readings and researches in the future. After all, justice should be for the accused, the victim and the state.
