'Denigration and Exploitation of Reputation in the Law of Comparative Advertising' Comparative advertising enables the advertiser to compare his goods to those of a competitor. Truthful comparative advertising provides useful information to consumers. However, comparative advertising discrediting a competitor or taking unfair advantage of a competitor's reputation will harm the competitor and is therefore unlawful under the directive on comparative advertising. The author examines the relevant provisions of the directive and proposes an amended version of the legal framework.
