In the context of the externalization of migration controls, what are the responsibilities of the European Civil Mission of Border Assistance undertaken in Libya in relation to the non-refoulement principle? On the 22nd of May 2013, the CSDP Mission EUBAM Libya was officially launched. Remarkably, the EUBAM Libya legal mandate did not contemplate any rule regarding the protection of migrants and refugees fundamental right in the field. The Article maintains that the examined EU mission did not try to change, but instead took advantage of the Libyan longstanding in-human regulations, where gross and systematic Human Rights violations occur against migrants and refugees seekers.
